By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

Eligibility

You must be at least 18 years old or have the consent of a legal guardian to use our Services. By using the Services, you represent and warrant that you meet these eligibility requirements and have the legal capacity to enter into these Terms.

Use of Services

When using our Services, you agree to:

• Provide accurate and complete information when registering or submitting data (e.g., fuel consumption or vehicle details).
• Use the Services only for lawful purposes and in accordance with these Terms.
• Not attempt to interfere with, hack, or disrupt the Services, including uploading malicious code or engaging in unauthorized access.
• Not reproduce, distribute, or modify any part of the Services without our prior written consent.

Account Responsibilities

To access certain features, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately at info@fueltracker.co.za if you suspect unauthorized use of your account. We reserve the right to suspend or terminate accounts for violations of these Terms.

Intellectual Property

All content, features, and functionality of the Services, including text, graphics, logos, and software, are the exclusive property of HashData or its licensors and are protected by South African and international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Services without our express written permission.

User-Generated Content

If you submit content to the Services (e.g., fuel logs, reviews, or feedback), you grant HashData a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, modify, and display such content in connection with the Services. You represent that you have the right to provide such content and that it does not violate any laws or third-party rights.

Payments, Subscriptions, and Refunds

Use of certain Services requires payment of various fees, as outlined below:

• Once-Off Fees: You may be charged a once-off connection fee, device purchase fee, and/or installation fee for each device used with the Services. These fees are non-refundable and must be paid prior to activation of the Services.
• Monthly Subscription Fee: A monthly subscription fee is charged per device for continued access to the Services. Subscriptions renew automatically unless canceled with at least one month’s written notice.
• Payments: You agree to provide accurate payment information and authorize us to charge applicable fees through our third-party payment processors (e.g., Stripe). All fees are non-refundable except as outlined below.
• Cancellation: You may cancel your subscription by providing one month’s written notice via email to info@fueltracker.co.za. Cancellation will take effect at the end of the billing cycle following the notice period, and you will remain liable for fees during the notice period.
• Refunds: Refunds are issued at our discretion. You may request a refund for the once-off connection fee, device purchase fee, or installation fee within 7 days of payment if the device has not been installed or activated. No refunds will be provided for monthly subscription fees, including for partial months, renewals, or unused services. To request a refund, contact us at info@fueltracker.co.za with your account and purchase details. Approved refunds will be processed within 14 business days.
• Fee Changes: We may modify fees with prior notice. Continued use of the Services after fee changes constitutes acceptance of the updated fees.

Limitation of Liability

To the fullest extent permitted by law, HashData and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services, including but not limited to loss of data, profits, or business opportunities. The Services are provided "as is" without warranties of any kind, express or implied, including accuracy or fitness for a particular purpose.

Indemnification

You agree to indemnify and hold harmless HashData, its affiliates, and their respective officers, directors, and employees from any claims, damages, or expenses (including legal fees) arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.

Termination

We may suspend or terminate your access to the Services at our discretion, with or without notice, for violations of these Terms or for any other reason. You may terminate your account at any time by contacting us at info@fueltracker.co.za. Upon termination, your right to use the Services will cease, but these Terms’ provisions on intellectual property, liability, and indemnification will survive.

Third-Party Services

The Services may include links to or integrations with third-party websites or services (e.g., payment processors or map providers). We are not responsible for the content, policies, or practices of these third parties, and you use them at your own risk.

Governing Law

These Terms are governed by the laws of South Africa, without regard to conflict of law principles. Any disputes arising from these Terms or the Services shall be resolved exclusively in the courts of Cape Town, South Africa.
